How long do we have to file in Texas?
Two years from the date of death under most circumstances. Shorter deadlines apply against governmental entities. Waiting can cost critical evidence and the right to sue altogether.
Is a wrongful death case different from a "survival action"?
Yes. A wrongful death claim compensates the family for their losses. A survival action, brought by the estate, compensates for damages the deceased themselves could have sued for (pain and suffering, medical costs before death). Both are typically brought together.
